Terms of Service

These Terms of Service ("Terms") govern your use of the Winston AI personal voice assistant application ("Winston," "the Service") operated by Winston AI ("we," "our," or "us"). By using Winston, you agree to be bound by these Terms.

1. The Service

Winston is a personal voice assistant powered by Claude (Anthropic) that provides daily briefings, reminders, voice-based task completion, and other personal assistance features. Winston is currently in beta and features may change during this period.

2. Eligibility

You must be at least 13 years of age to use Winston. By using the Service, you represent that you meet this age requirement. Winston is intended for personal, non-commercial use.

3. Account Registration

To use Winston, you must create an account using Google Sign-In. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

Winston is a subscription service. During the beta period, your first month is free with no credit card required. After the beta period, continued use requires a paid subscription at the rate in effect at that time. We will provide advance notice of any pricing changes.

• Subscriptions are billed monthly
• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• We do not offer refunds for partial subscription periods

5. Acceptable Use

You agree to use Winston only for lawful purposes and in accordance with these Terms. You agree not to:

• Use Winston to harass, abuse, or harm any person
• Attempt to gain unauthorized access to Winston's systems or other users' accounts
• Use Winston to generate spam, fraudulent content, or misleading communications
• Reverse engineer, decompile, or attempt to extract the source code of Winston
• Use Winston in any way that violates applicable laws or regulations
• Share your account credentials with others

6. Google Services Integration

Winston integrates with Google services including Gmail, Google Calendar, Google Contacts, and Google Maps. By connecting your Google account, you authorize Winston to access these services on your behalf. You can revoke this access at any time through your Google Account settings. Winston's use of Google user data is subject to the Google API Services User Data Policy, including the Limited Use requirements.

7. AI-Generated Content

Winston uses artificial intelligence to generate responses, compose messages, and provide assistance. You acknowledge that:

• AI-generated content may occasionally be inaccurate, incomplete, or inappropriate
• Winston does not provide medical, legal, financial, or professional advice
• You are responsible for reviewing AI-composed messages before sending them
• Winston's responses should not be relied upon as a substitute for professional judgment

8. Privacy

Your use of Winston is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Winston, you consent to the collection and use of your information as described in the Privacy Policy.

9. Intellectual Property

Winston and all related technology, software, and content are owned by Winston AI and protected by applicable intellectual property laws. You retain ownership of all content you provide to Winston, including your personal information, preferences, and conversation history.

10. Disclaimers

WINSTON IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT WINSTON WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOUR USE OF WINSTON IS AT YOUR OWN RISK.

Winston is a personal assistant tool and is not a substitute for emergency services. In the case of an emergency, always contact emergency services directly by calling 911 or your local emergency number.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WINSTON AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Termination

We reserve the right to suspend or terminate your access to Winston at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting us at david@getwinstonai.com. Upon termination, your right to use Winston ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the Winston app. Your continued use of Winston after changes become effective constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Dallas County, Texas.
